Hello and welcome to Nurture & Nanny’s June Newsletter!

I hope that you are well and enjoying this wonderful weather.  It’s that time of year when we pack up the beach bags and head out to enjoy summer vacation.  Some of you will be taking your nannies with you while you travel and might be wondering what your obligations are. 

According to Stephanie Breedlove, founder of Austin-based Breedlove & Associates (www.breedlove-online.com) employment law dictates that vacation travel with your nanny be treated like a business trip for your nanny – the employer (the family) is required to compensate the employee (the nanny) for all hours worked during the trip (this includes travel time).  The family is also required to pay for the nanny’s travel expenses as well as their room and board during the trip.  If the working time exceeds 40 hours in a 7 day period, the family is required to pay overtime at a rate of 1.5 times the regular wage. 

Because it’s a vacation, there is often a question about what should be considered “working time.”  The rule of thumb is fairly simple: if the nanny is in charge of watching the children – even if she’s doing it from a lounge chair on the beach or at an amusement park – it’s considered “working time.”

Having heard from many of Breedlove’s clients about traveling with their nanny, they would like to share a common suggestion:

Working hours on vacation trips are often very different than the normal schedule.  So if your employee is on a fixed salary, consider converting the salary into an hourly rate and then having a discussion about compensation before the trip.  This will ensure fair pay for hours worked and prevent a situation where one of the parties feels cheated or resentful.
